1. About these terms

These terms govern your use of folaadeleke.com (“the site”), operated by Fola Adeleke® (“we”, “us”, “the studio”). By using the site you accept them. If you do not accept them, please do not use the site.

2. Intellectual property

All artwork, photographs, images, text, layout and design on this site are owned by Fola Adeleke® or used under licence, and are protected by copyright and other intellectual property rights. The name “Fola Adeleke®” and the studio marks are ours.

You may:

• view, browse and print pages for your own personal, non-commercial reference;
• share links to the site; and
• use images we have expressly supplied for press use, in line with any conditions attached to them.

You may not, without our prior written permission:

• reproduce, redistribute, publish or commercially exploit any artwork or image from this site;
• use any content to train, fine-tune or otherwise develop a machine learning or generative AI model;
• use automated tools to scrape, mine or systematically download content from the site;
• remove or obscure any copyright notice, watermark or attribution; or
• use our name or marks in a way that suggests endorsement or association where none exists.

Buying a print gives you ownership of that physical print. It does not transfer copyright or any reproduction right in the underlying work, which we retain.

3. Certificates of authenticity

Limited-edition prints are supplied with a certificate of authenticity carrying a unique verification link on this site. A verification page confirms only that the certificate reference matches our studio register. It is not a valuation, and it is not a guarantee about the condition of a print or about any subsequent sale between third parties. If you believe a certificate has been copied or misused, please tell us.

4. Acceptable use

You agree not to:

• use the site for any unlawful or fraudulent purpose;
• submit anything through our forms that is unlawful, defamatory, abusive, or infringes anyone's rights;
• submit bulk, automated or spam submissions;
• knowingly introduce malware, or attempt to gain unauthorised access to the site, its servers or any connected system; or
• interfere with the site's operation or availability.

We may remove content and withdraw access where these terms are breached.

5. Content you submit

When you send us an enquiry, feedback or an application, you confirm that what you send is accurate and that you are entitled to send it. We handle it in line with our Privacy Policy.

If you send us feedback about our work or the site, you agree we may use it to improve what we do, and quote it anonymously in our marketing. If you would rather we did not, tell us and we will not.

6. Commissions and enquiries

An enquiry submitted through the site is not an offer or a binding order. Commissions and commercial or trade orders proceed only once we have agreed scope, price and timescales with you in writing, and those written terms will govern the work.

7. Accuracy and availability

We take care to keep the site accurate and up to date, but we do not warrant that it is free of errors or omissions, or that it will always be available or uninterrupted. Prices, editions and availability shown on this site are indicative; the shop is the authoritative source. Colours reproduced on a screen will differ from the printed work.

We may change, suspend or withdraw any part of the site, and may update these terms. The version published here at the time you use the site is the version that applies.

8. Links to other sites

The site links to third-party sites and services, including our Shopify store, Instagram, TikTok, Spotify and our newsletter provider. We are not responsible for their content or their practices, and a link is not an endorsement. Their own terms and privacy notices apply.

9. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

Subject to that, we are not liable for any loss of profit, loss of business, business interruption, or loss of anticipated savings arising from your use of, or inability to use, this site, or from reliance on any content on it. If you are a consumer, we are liable for loss that is a foreseeable result of our breach, and these terms do not affect your statutory rights.

10. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your own jurisdiction.
